Information Collection and Use. The Human Equation collects personal information from our users at several different points on our website. This includes, but is not limited to, first name, last name, email address, mailing address, phone, billing information (for purchases), device information and analytics information. Student performance data is gathered for our Learning Management System (ex: course tracking data, login activity) in order to verify completion of courses and award education credits. Learning Management System information is available for viewing to selected managers of the companies which the users belong to. Otherwise, the Human Equation is the sole owner of the information collected on this site. The Human Equation does not sell, share or rent information to others in ways different from what is disclosed in this policy.

 

In addition to the above, we and our third-party partners may use personal information for any lawful purpose, including the following:

 

  • To create, maintain and service your account;
  • To respond to your inquiries or otherwise communicate with you;
  • To evaluate your eligibility for and provide Services you request, including to provide publications to which you subscribe;
  • To operate, personalize, and improve the Sites and their features, including for analytics purposes;
  • To send promotions and marketing materials that may be of interest to you in accordance with applicable laws;
  • To present advertising online and via other communication channels, including through social media platforms and internet search engines;
  • To send you important information regarding the Services, such as certain changes to our terms, conditions, policies, and other administrative information. Because this information may be material to your use of the Services, you may not opt-out of receiving such communications;
  • To administer and manage our vendors and business partners;
  • To analyze, improve and grow our business;
  • To help maintain and enhance the safety, security, and integrity of our property, products, Services, technology, assets, and business;

Feedback Form. Name and email address are requested in our feedback form on the Contact Us page. This information is used only for the purpose of replying to comments and requests for information and is not made available to any outside party.

 

Cookies. A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is in no way linked to any personal information while on our site. We use both session ID cookies and persistent cookies. For session cookies once the user closes his/her browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user’s hard drive for an extended period of time. For instance, by setting a cookie on our site, the user would not have to log in a password more than once, thereby saving time while on our site. If a user rejects the cookie, he/she may still use our site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site.

 

Log Files. We use IP addresses to analyze trends, administer the site, track users’ movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personal information.

 

Third Party Tracking. The use of cookies by our partners, affiliates, tracking utility company and service providers is not covered by our privacy policy. We do not have access or control over these cookies.

 

Disclosure When Required by Law. We may disclose personal information when required by law.

We reserve the right to disclose your personal information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our website. If The Human Equation is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

 

Newsletter. If a user wishes to subscribe to our newsletter, we ask for contact information, such as name and email address. When users subscribe to a newsletter, their information is captured by a third party email marketing service (www.benchmark.com). This third party is simply acting as a service provider and collecting the information on behalf of The Human Equation. The personal information provided by the user is being used solely by The Human Equation and is protected under the Privacy Policy that you are currently reading. The service provider is authorized to use your personal information only as necessary to provide such service to us. Out of respect for your privacy, you may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails.

 

Security. We take precautions to protect our users’ information. When you submit sensitive information via the website (such as credit card number), your information is protected with the best encryption software in the industry – Secure Socket Layer (SSL). While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect user information offline. Our site and all customer data reside on our secure in-house server, behind our firewall. Our customer database is backed up regularly, and access to personal account information is limited to only those employees who need the information to perform a specific job. Employees must use password-protected screen-savers when leaving their work area, which further protects customer information from unauthorized access. All employees are kept up-to-date on our security and privacy practices. During orientation, as well as any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our customers’ information remains secure and protected at all times.

 

Special Offers. We send all new newsletter subscribers a confirmation email. Established subscribers will periodically receive information on products, services, special deals and a newsletter. Out of respect for the privacy of our users, we present the option to not receive these types of communications. Please see our Choice/Opt-out section below.

 

Site and Service Updates. We also send users site and service announcement updates. Users are not able to unsubscribe from service announcements, which contain important information about the service. We communicate with users to provide requested services, and in regards to issues relating to his/her account via email or phone.

 

Correction/Updating/Deleting Personal Information. If a user’s personal information changes (such as email address), or if a user no longer desires our service, we will endeavor to correct, update or remove that user’s personal data provided to us once we receive notification of the needed update. Personal information that needs to be updated within the Learning Management System can be done by the user by editing the content found within the user’s logged in User Preferences page, found under Administration in the main menu. Personal information that needs to be updated within our email marketing service provider, in order to continue to receive newsletters should a user’s email address change, and any other needed updates, can be done by contacting Customer Service or calling us at 1-954-382-0030.

 

Data Retention. We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services contact us at webmaster@thehumanequation.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

Choice/Opt-out. Users/Subscribers who no longer wish to receive periodic communications, newsletters, or promotional materials from us may unsubscribe from our mailing lists. To do so, the user must scroll to the bottom of the communication, for instance, the email newsletter, where the user will find the option to manage preferences, opt-out, or sign up for future emails. To unsubscribe, the user must click the opt-out link within that communication.

 

Links to 3rd Party Sites. Our website includes links to other Web sites whose privacy practices may differ from those of The Human Equation. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any Web site you visit.

 

Blog / Forum. Our website offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at webmaster@thehumanequation.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

 

Social Media Widgets. Our website may include Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

 

Notification of Changes. This privacy policy is subject to change without notice. Prior to any material changes we will notify you by email or by means of a notice on this Web site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy policy.
